Will of Thomas W. Fuller

Be it remembered that at a Surrogate Court held at Delhi, in and for the County of Delaware on the 11th day of March, 1867, the last Will and testament of Thomas W. Fuller, late of the town of Colchester, in the County of Delaware, deceased was duly proved before William Murray, Jr., Surrogate of the said County, and was thereupon declared by the said Surrogate ????established as a Will of real and personal estate and the same together ???? the proofs and examinations taken therein are here recorded ???? order of the said Surrogate to wit.

In the name of God Amen, I, Thomas W. Fuller, of the town of Colchester, in the County of Delaware and State of New York, of the age of seventy-five years and being of sound mind and memory, do make, publish, and declare this my last Will and Testament in the manner following that is to say:

In witness whereof I have hereunto set my hand and seal, this twenty-second day of January, one-thousand eight-hundred and sixty-seven.

Witnesses, John F. Odwell residing at Downsville, Delaware County, state of New York, Anson B. Fuller, residing at Colchester, Delaware County, state of New York. Subscribed by Thomas W. Fuller the testator named in the foregoing Will in our presence and at the time of making such subscription declared by the testator to be his last Will and testament, and each of us sign his name as a witness at the end of the Will, at the request of the testator, and in his presence.

Delaware County Surrogate Court
In the matter of the Probate of the last Will and testament of Thomas W. Fuller, late of said county, deceased, as a Will of Real & Personal Estate.
John Odwell of the town of Colchester, in the County of Delaware, being sworn, deposes that he saw the above named Thomas W. Fuller, deceased, late of the town of Colchester, in the County of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Thomas W. Fuller, and ???? the 22nd day of January, 1867 and that he heard the said Thomas W. Fuller declare the same to be his last Will and Testament and that he, this deponent, together with Anson B. Fuller, the other subscribing witness subscribed his name as a witness to said instrument at his request and at the time thereof the said Thomas W. Fuller was of sound mind and memory of full age to make said Will and not under any restraint.

Anson B. Fuller of the town of Colchester, in the County of Delaware, being sworn, deposes that he saw the above named Thomas W. Fuller, deceased, late of the town of Colchester, in the County of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last Will and Testament of the said Thomas W. Fuller, and bears date the 22nd day of January, 1867 and that he heard the said Thomas W.
