In the matter of the probate of the last will and testament of Nathan Fuller, late of said county deceased, as a will of real and personal estate.

I, Nathan Fuller, of the town of Colchester do make this my last will and testament. First, I give and devise unto my beloved wife, Chloe Fuller, all and every my said ??? or tenant with the ??? situate in the said town of Colchester with the lands and hereditaments hereunto belonging and the ??? issues and profits thereof for and during the term of her natural life; and this bequest is hereby made with this proviso and conditions that my said wife Chloe shall and will clothe and maintain and support my daughter Chloe Fuller at her own cost and expense out of the avails of the said tenement or farm so long as they both shall live. Also, from and after the decease of my said wife, Chloe, I give and bequeath the said ??? or tenement lands and hereditaments unto the following of my sons and daughters to wit: Thomas W. Fuller, Ransom Fuller, John D. Fuller, Hiram Fuller, Lorimer Fuller, Rachel ???, Phebe Bogart and Loretta Monfort and to their heirs and assigns forever as tenants in common. And this bequest is also made with the like proviso and condition as above that my said daughter Chloe if the services and ??? at the decease of my said wife then and in that case a sufficient portion of the avails of the said tenements or farm shall be set off and applied to clothe, maintain and comfortably support my said daughter Chloe for and during the term of her natural life and the above bequest are made subject to the tax and encumbrance of securing a decent and a comfortable support to her so long as she may live and require the same.

Also, I give and bequest unto my said daughter Chloe, one cow, six sheep, two beds, bedsteads and bedding for the same. All the rest and ??? of my personal estate whatsoever after payment of my debts and funeral expenses I do give and bequeath unto my said wife, Chloe, her executors administrators and assigns to and for her and their use and benefit absolutely. And I do hereby constitute and appoint my son, Ransom Fuller and my son-in-law, Jarod G. Monfort, my executors of this my last will and testament. In witness whereof I have hereunto set my hand and seal the 19th day of April in the year of our Lord, 1845.

In the matter of the probate of the last will and testament of Nathan Fuller, late of said county, deceased, as a will of real and personal estate. James W. Knapp of the town of Colchester in the County of Delaware, being first duly sworn, deposes and says that he saw the above named Nathan Fuller, late of the town of Colchester in the county of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last will and testament of said Nathan Fuller and bears date the 19th day of April 1845 and that he heard the said Nathan Fuller declare the same to be his last will and testament, and that this ??? together with William E. Knapp and John Radcliff, the other subscribing witnesses, subscribe their names as witnesses to said instrument at his request and at the time thereof the said Nathan Fuller was of sound mind and memory of full age to make said will and not under any restraint.

Knapp of the town of Colchester in the county of Delaware being first duly sworn, deposes and says that he saw the above named Nathan Fuller, late of the town of Colchester in the county of Delaware, deceased, subscribe and execute the instrument now shown him and which purports to be the last will and testament of the said Nathan Fuller and bears date the 19th day of April 1845 and that he heard the said Nathan Fuller declare the same to be his last will and testament and that he ??? together with James W. Knapp and John Radcliff, the other subscribing witnesses, subscribe their names as witnesses to said instrument at his request and at the time thereof, the said Nathan Fuller was of sound mind and memory and of full age to make said will and not under any restraint.
